Terms of Service

Article 1 (Scope and Acceptance)

These Terms set out the conditions for using all websites and services provided by the operator (the "Operator"), including omikuji.dev and its related subdomains that provide various tools (collectively, the "Services"). By viewing or using the Services, you are deemed to have agreed to these Terms and to the Privacy Policy (including the use of cookies for analytics, advertising and affiliate programs). If you do not agree, please refrain from using the Services.

Article 2 (Disclaimer — Important)

1. The Operator makes no warranty, express or implied, that the Services are free of defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose or security, as well as errors, bugs and infringement of rights).
2. The Operator accepts no liability whatsoever for any damage arising from the Services (including, without limitation, loss of data, device failure, lost opportunities and emotional distress). Use the Services entirely at your own risk.

Article 3 (Accounts and Passwords)

1. If you create an account on any of the Services, you are responsible for keeping your password strictly confidential.
2. To protect privacy, the Operator strongly encrypts its databases, and even the administrator cannot recover or view the original password. Therefore, for accounts without a registered email address, the Operator cannot respond to requests such as "I forgot my password" with any recovery or reissue whatsoever.
3. If you would like a way to recover a lost password, you may optionally register an email address. Only in that case can you regain access to the account by resetting the password. Registered email addresses are handled as set out in Article 2 of the Privacy Policy.

Article 4 (Intellectual Property)

Copyright and all other intellectual property rights in the data, programs, text, images, layouts and other materials that make up the Services belong to the Operator or to their rightful owners. Reproducing, reposting, modifying or redistributing them without the Operator's prior written permission is strictly prohibited.

Article 5 (Prohibited Conduct)

You must not do any of the following while using the Services. If a violation is found, the Operator may immediately restrict your use (deny access, delete your account, etc.) without prior notice and, in serious cases, will report the matter to the police and take legal action such as claims for damages.

1. Placing an excessive load on the Services' network or systems (excessive scraping, continuous requests, denial-of-service attacks, etc.).
2. Nuisance conduct that causes disadvantage, damage or discomfort to the Operator, other users or third parties.
3. Collecting, copying or repurposing data on the Services without the Operator's prior permission.
4. On services that accept submissions, posting any of the following:
   • Content that violates laws or public order and morals.
   • Content that infringes the copyright, trademark, portrait rights, privacy, reputation or any other right or interest of a third party.
   • Depictions of the sexual exploitation or sexual abuse of children (including child sexual abuse material) or any other illegal or harmful content.
   • Obscene, violent or discriminatory content, harassment, bullying or threats.
   • Impersonation of others, false information, or the posting of a third party's personal information without their consent.
   • Content that departs markedly from the purpose of the service, content whose main purpose is advertising or solicitation, and repeated posting of identical or similar content.
5. Any other conduct the Operator deems inappropriate.

Article 6 (User Submissions)

1. This Article and Articles 7 and 8 apply to services on which users can post text, images and the like. Content posted by a user is referred to as a "User Submission".
2. User Submissions are published so that third parties can view them. The Operator does not intend the Services to be used as a place to store data privately. Do not post anything you would not want made public.
3. The user who posts a User Submission bears full responsibility for its content. The user warrants that they have the right to post it and that it does not infringe the rights of any third party.
4. The user grants the Operator a royalty-free licence to use User Submissions to the extent necessary to provide, maintain and improve the Services (including displaying and reproducing them, making backups, generating information for search engines, and the automated processing set out in Article 3 of the Privacy Policy). This licence continues after a submission is deleted only until it is erased from backups and the like.
5. The Operator is under no obligation to monitor User Submissions at all times. However, automated screening and after-the-fact review are carried out as described in the next Article.

Article 7 (Removal and Hiding of Submissions)

1. If the Operator determines that a User Submission falls under any of the following, the Operator may, without prior notice, delete or hide all or part of it, or suspend the account:
   • It violates the prohibitions in Article 5.
   • It infringes, or is reasonably suspected of infringing, the rights of a third party.
   • Automated screening has flagged it as potentially inappropriate (including temporarily hiding it until the Operator has reviewed it).
   • The Operator otherwise reasonably determines it to be inappropriate.
2. The Operator is under no obligation to explain individual decisions to delete or hide content. Requests based on infringement of rights, however, are handled under the procedure in the next Article.

Article 8 (Removal Requests)

1. Anyone who believes a User Submission infringes their rights, and anyone concerned by the content posted, may request removal through any of the following:
   • The "Report" link provided on the page of the submission in question.
   • The "Request removal" form provided on some services.
   • If neither is available, or if you cannot identify the page in question, the contact form.
2. When making a request, please tell us the URL in question, your relationship to the content, and the reason you are requesting removal. Without these, the Operator may be unable to identify the content or respond.
3. On receiving a request, the Operator will normally review it within a few days and, where deemed necessary, delete the content or take other measures. To the extent needed to reach a decision, the Operator may inform the posting user of the request and ask for their view.
4. Please check the outcome by looking at whether the page in question is still displayed. For requests made through channels that do not collect contact details, the Operator may be unable to reply individually.

Article 9 (Suspension, Changes and Termination)

Because the Services are run by an individual, the Operator may at any time and for any reason change all or part of the Services, temporarily suspend them, or terminate them entirely, without prior notice. The Operator accepts no liability for any damage this causes to users.

Article 10 (Advertising and Affiliate Links)

The Services display advertisements delivered by third parties, as well as links and product recommendations under the various affiliate programs the Operator participates in (Amazon Associates, Rakuten Affiliate, a range of affiliate service providers, and others). The Operator may earn referral fees or other income through these advertisements and links. The Operator accepts no responsibility for transactions with, or information provided by, advertisers or the sites you are taken to. See the Privacy Policy for details.

Article 11 (Changes to These Terms)

The Operator may change these Terms as necessary. The revised Terms take effect when posted on this page, and if you continue to use the Services after they are posted you are deemed to have agreed to the revised Terms. The date of revision is shown as "Last revised" at the top of this page.

Article 12 (Governing Law)

These Terms and your use of the Services are governed by the laws of Japan.
